Terms of service (AGB)
These general terms and conditions (AGB) govern the use of PairMuse and the paid plans. Use “Print” to print them or save them as a PDF.
§ 1 Scope and parties
- These terms apply to all contracts between you and PairMuse e.K. for the use of PairMuse at https://pairmuse.com, in the browser and as an installed app. Other terms apply only if we expressly agree to them.
- Your contracting party is PairMuse e.K., owner: Mohammed Hussam Al Turjman, TodoStrasse 1, 11111 Bremen, Germany, email: help@pairmuse.com, telephone: 0049111111111, registered in the commercial register (TodoAmtsgerich Bremen, HHH 12345 HH) (“we”).
- A consumer is any natural person who enters into a contract for purposes that are predominantly outside their trade, business or profession (Section 13 BGB). Some rules, such as the right of withdrawal, apply to consumers only; we say so where they appear.
- How we handle your data is set out in the privacy notice at https://pairmuse.com/legal/privacy.
§ 2 What PairMuse offers
- PairMuse is a fashion platform. You can build a wardrobe of your pieces, discover and save products from shops, publish pieces on your profile, follow others, like, comment on and save posts, write end-to-end encrypted messages and use the AI assistants Muse and Stylist.
- On the free plan (Free) you use every feature except Muse and Stylist. The paid plans Pro and Max also include credits for Muse and Stylist every month (§ 8). The plans page in PairMuse shows what each plan includes.
- Products in Discover and in the assistants’ suggestions come from shops’ websites. We do not sell products. If you buy a product, you contract directly with the shop; we are not party to that contract. Prices, sizes and availability reflect the time we retrieved them; the shop’s offer is what counts.
- You need a current browser and an internet connection for PairMuse. Without a connection PairMuse does not work. Background notifications require a browser that supports web push.
§ 3 Account, minimum age and sign-in details
- You need an account to use PairMuse. You register with your name, email address and password or, where offered, through Google, Apple or your organization’s SSO. Your details must be correct; if something changes, update them.
- You must be at least 16 years old. You confirm this when you register or, if you create your account through Google, Apple or your organization’s SSO, when you first sign in. If you are under 18, you need the consent of your parents or other legal guardians for the contract. Only members aged 18 or over can take out a paid plan.
- If we learn that an account belongs to a person under 16, we end the contract and delete the account. We tell you beforehand and give the reason.
- Each account belongs to one person. Keep your sign-in details secret and do not share them. If you suspect someone is misusing your account, end all unfamiliar sessions in Settings under Account and write to security@pairmuse.com.
- You can delete your account at any time in Settings under Account. This needs a sign-in with a second factor; signing in with a passkey is enough. If you cannot sign in that way, you request deletion by email to privacy@pairmuse.com. The deletion takes effect after a 30-day waiting period; until then you can undo it. If you have a paid plan, it ends with its current billing period and is not renewed; if you restore your account within the 30 days, you can resume the plan in Settings under Billing while that billing period runs.
§ 4 How the contract is concluded
- You conclude the contract for the free plan by completing the registration form and clicking “Create my studio” (in German “Studio erstellen”; after an invitation “Create my account”, in German “Konto erstellen”), or by signing in through a provider for the first time. The contract is concluded when we create your account.
- You order a paid plan like this: you choose Pro or Max on the plans page. The order page shows you, directly above the button, the main characteristics of the plan, the total price, the term and the cancellation terms. You choose the contract language, German or English. With the optional box on the order page you can expressly request that we start the service right away (§ 7(4)). Your plan starts right after the order either way; the box only decides what a withdrawal within the withdrawal period costs you. Clicking “Order with obligation to pay” (in German “Zahlungspflichtig bestellen”) concludes the contract.
- We confirm receipt of your order by email at once. We then take you to our payment service provider Stripe, where you authorize the payment. Before we activate your plan, you receive from us by email, on a durable medium, the confirmation of the contract with its content, these terms as a PDF, the withdrawal information with the model withdrawal form and a record of whether you requested the immediate start. We charge your card for the first time when you authorize the payment at Stripe, and after that at the start of each billing period. If you do not complete the payment at Stripe within 24 hours, the order lapses and neither side has any remaining obligations under the contract.
- Until you click “Order with obligation to pay” you can change your choice at any time: the link back to the plans page lets you pick another plan, and you switch the contract language on the order page. At Stripe you check and correct your payment details before you authorize the payment.
- We accept credit and debit cards, also through the wallets Stripe offers on your device, such as Apple Pay or Google Pay. There are no delivery restrictions.
- Moving from Pro to Max is a new order through the order page; paragraphs 2 and 3 apply accordingly. The larger plan applies right after the order: for the rest of the current billing period you pay the difference, and we credit the unused time of your previous plan. A move to a smaller plan takes effect at the end of the current billing period.
- We store the contract text, that is, your order details and the version of these terms that applies when you order. You receive this version as a PDF with the confirmation of the contract (paragraph 3). You can retrieve, print or save the current version as a PDF at any time at https://pairmuse.com/legal/terms; we will send you earlier versions on request.
- The contract languages are German and English; § 18(1) governs which one applies to your contract. We have not subscribed to any codes of conduct.
§ 5 Prices, payment and invoices
- The prices shown on the order page when you order apply. They are total prices in US dollars (USD) per month; there are no further costs. As long as PairMuse is a small business under Section 19 UStG, no VAT is shown.
- If your card is held in another currency, your bank converts the amount and may charge a fee for it; we have no influence on that.
- You pay the price monthly in advance at the start of each billing period. Stripe charges your card for it.
- If a payment fails, we let you know by email and try again. If the payment still fails by the deadline we give you in the email, which is at least seven days, your paid plan ends and your account moves to the free plan. Amounts already due remain owed.
- We send invoices by email as a PDF; you agree to this. You also find them in Settings under Billing.
- If you cancel in the ordinary way or move to a smaller plan, we do not refund any part of the current billing period; your plan stays usable until it ends. Statutory refund rights remain unaffected, for example after a withdrawal, because of a defect, after ending the contract because of a change (§ 12) or after a termination for good cause.
§ 6 Term and cancellation
- The contract for the free plan runs indefinitely. You end it by deleting your account (§ 3(5)); as a consumer you can also withdraw from it (§ 7).
- A paid plan runs indefinitely and is billed monthly. There is no minimum term. You can cancel it at any time with effect from the end of the current billing period.
- To cancel, use the button “Cancel contracts” (in German “Verträge hier kündigen”) at https://pairmuse.com/legal/cancel or in Settings under Billing. It takes you to a page where you state only whether you cancel in the ordinary way or for good cause (with a reason for good cause), who you are, which contract you cancel, when it should end and the email address for the confirmation. You submit the cancellation with “Cancel now” (in German “Jetzt kündigen”). We confirm at once by email its content, the date and time we received it and the day the contract ends.
- You can also cancel in text form, for example by email to help@pairmuse.com. The cancellation counts from the moment it arrives.
- When a paid plan ends, your account moves to the free plan. You can use your credits until the end of the billing period. After that Muse and Stylist are no longer available; everything else stays as it is.
- We can terminate the contract with two months’ notice, a paid plan with effect from the end of a billing period. We terminate by email.
- Both sides keep the right to terminate for good cause without notice (Section 314 BGB). Good cause for us exists in particular if you breach these terms seriously or repeatedly despite a warning. Before such a termination we proceed under § 11(6). If we terminate for good cause, we refund amounts already paid for the time after the contract ends.
§ 7 Right of withdrawal
- As a consumer you have a statutory right to withdraw within 14 days of the conclusion of the contract, from the free plan as well as from a paid plan. The details and the model withdrawal form are in the withdrawal information (Widerrufsbelehrung) at https://pairmuse.com/legal/withdrawal.
- You can withdraw with the function “Withdraw from contract” (in German “Vertrag widerrufen”) at https://pairmuse.com/legal/withdraw or in Settings under Billing. You give your name, the contract, that is, the free plan or a paid plan, and the email address for the confirmation and click “Confirm withdrawal” (in German “Widerruf bestätigen”). We send you an acknowledgment of receipt without undue delay, with the content of your withdrawal and the date and time it arrived, to the email address you gave. You can also withdraw by email or letter.
- If you withdraw from the contract for the free plan, we close your account; this costs you nothing.
- With the optional box on the order page you can expressly request that we start your paid plan before the withdrawal period ends. Your plan starts right after the order either way. If you ticked the box and withdraw, you pay a reasonable amount for the time until the withdrawal, calculated from the share of days in the billing period (Section 357a(2) BGB); we refund everything else within 14 days. If you did not tick it, a withdrawal costs you nothing: we refund everything you paid within 14 days.
§ 8 Credits and AI assistants
- A paid plan includes an allowance of credits every month. The plans page and the order page show how many. The full allowance is available at the start of each billing period.
- Muse and Stylist use credits while they work for you. How many depends on how much computing power of the AI models a reply needs: a short answer needs a few credits, a live web search the most. The plans page gives typical figures. On Pro and Max, reading the photos of a new piece in your wardrobe also uses some credits; on the free plan it is included. You see your usage in Settings under Usage.
- Unused credits expire at the end of the billing period; each period starts again with the full allowance. Credits are not money. You cannot have them paid out, transfer them or buy them separately.
- A reply that Muse or Stylist has started always finishes, even if your credits run out along the way. It costs nothing extra and is not deducted from the next period. New requests are possible again only when your plan renews or you move to a larger plan.
- Muse and Stylist are AI systems we run on models from OpenAI, Anthropic, xAI and Google. A line under the input field of every conversation with Muse or Stylist says that the assistant is an AI and can make mistakes. Their replies are generated by AI and can be wrong, incomplete or out of date. Check important details such as sizes, prices, availability and care instructions with the shop. The assistants do not give medical, financial or legal advice.
- Do not use Muse and Stylist to create illegal content or to infringe the rights of others. Do not disclose other people’s data in conversations unless your question needs it.
§ 9 Your content and the rights you grant
- What you upload or write on PairMuse remains yours: photos, pieces, captions, comments, profile details and messages.
- So that we can run PairMuse, you grant us a simple (non-exclusive), royalty-free right to use your content, limited to these purposes: storing it, also keeping it in backups, processing it technically (such as adjusting the size and format of images), showing it to the audience you choose, checking it for legal violations, making it searchable and sending it to our AI providers where Muse, Stylist or reading photos needs it. We grant sublicenses only to service providers working for us, such as for hosting, delivering images and the AI models. We do not use your content for advertising.
- The right to use ends when you delete the content or your account. Backups that exist until then we delete when they expire as scheduled.
- Without your separate consent we do not train AI models on your content, and neither do our AI providers. The setting “Improve PairMuse for everyone” only allows us to evaluate conversations with Muse and Stylist to improve the assistants; it involves no training of AI models.
- Upload only content to which you hold the necessary rights. If a photo shows other people, you need their consent. Quotations, caricature, parody and pastiche remain permitted by law (Section 5 UrhDaG, Sections 51 and 51a UrhG).
- When the contract ends, we no longer use content you provided or created that is not personal data, except in the cases of Section 327p(2) BGB. On request we make it available to you free of charge in a common, machine-readable format.
§ 10 Rules of conduct
On PairMuse, be respectful, honest and lawful. These are not allowed:
- illegal content, such as insults, threats, incitement to hatred or spreading other people’s works without permission
- hate, harassment, bullying and the glorification of violence
- sexually explicit content and intimate images of other people without their consent
- content that endangers children or young people; we report depictions of child sexual abuse to the authorities
- photos of people who have not agreed to be shown
- infringements of copyright, trademark and personality rights
- false identities and pretending to be someone else
- spam, fraud, misleading offers and advertising not labeled as advertising
- malware, attacks on PairMuse and circumventing security measures
- automated harvesting of content without our permission
- misusing the reporting function, for example with knowingly false notices
If you publish something for commercial purposes, for example as a brand or in return for payment, label it as advertising.
§ 11 Moderation, notices and suspensions
- We moderate content to enforce these terms and the law. We act diligently, objectively and proportionately and respect the fundamental rights of everyone involved, especially freedom of expression (Art. 14(4) DSA).
- An automated text check, an AI model, reviews captions and intro notes on follow requests before publication and comments after publication. A caption or an intro note it cannot clear is not published, and we tell you so when you send it, with the kind of reason. If it rates such a text as clearly not allowed, we refuse it. If the result is unclear or the check is not possible, we hold back a caption, and we do not send a follow request with an intro note. If a text is held because the check could not run, we run the check again automatically and publish the text if the repeated check clears it. A person reviews held texts by the next working day at the latest and publishes or removes them. If the check holds back the changed caption of a published post, we take the post off the feed until the decision; if a person removes a caption, we remove the post it belongs to. You can object to a hold at any time, and to a refusal like any decision (paragraph 7), each by writing to dsa@pairmuse.com; a person then reviews the text and decides again. For an intro note a person reviews your objection and tells you the outcome; we cannot release the note itself afterwards. We publish a comment at once, and the text check usually reviews it within seconds. If it rates the comment as clearly not allowed, or if the result is unclear, we flag the comment: then only you can see it, and we show you the kind of reason with the comment. Others do not see the replies to a flagged comment while it is flagged. If a person removes a comment that has replies, the replies are no longer shown either. If the check is not possible, the comment stays visible and we run the check again automatically. You can send a flagged comment again in a changed form; it then appears at once and is checked like any comment. We count each rating of one of your comments as clearly not allowed, including the rating of a version sent again; we do not count an unclear result. The count does not expire. After ten such ratings, we switch off commenting for your account and tell you so by email. You can then no longer write or change comments or replies; you can keep using everything else in PairMuse. Commenting stays switched off until a person switches it back on. You can object to a comment being flagged and to commenting being switched off within four weeks by writing to dsa@pairmuse.com (paragraph 7); a person then decides again. The check does not review the text of a notice: every notice reaches us, and a person reads it and decides on it.
- Anyone can report content they consider illegal or in breach of these terms, even without an account: through the notice form at https://pairmuse.com/legal/dsa/notice or by email to dsa@pairmuse.com. We confirm receipt, review the notice and tell the person reporting our decision. The page “Report content” at https://pairmuse.com/legal/dsa describes how this works.
- Possible measures are: holding back or removing content, restricting its visibility, limiting individual features such as comments or messages, suspending an account for a time or terminating the contract. We choose the mildest measure that is enough.
- If we restrict your content or your account, we tell you at the latest when the measure starts and give reasons: what we did and for how long, which facts we rely on, whether automated means were involved, which rule or law the content breaches and how you can challenge it (Art. 17 DSA). If the automated text check refuses a caption or an intro note or holds back a caption (paragraph 2), we tell you when you send it: with the kind of reason, the rule we rely on, that automated means were involved, and how you can challenge it. If we flag a comment (paragraph 2), we show you the same details with the comment.
- Before we suspend an account or terminate the contract for breaches of these terms, we announce it, give the reason and give you the opportunity to respond; then we decide again. We act without hearing you first only where immediate action is needed, for example for content that endangers life, health or children, or for an attack on PairMuse. We then hear you without delay afterwards.
- You can object to any decision within four weeks of the decision by replying to our message or writing to dsa@pairmuse.com. A person reviews your objection and decides again; we tell you the result with reasons. If a person upholds your objection, they publish a held or refused caption, show a flagged comment to everyone again or switch commenting back on; an intro note cannot be released afterwards. A removed text cannot be restored; if your objection to a removal is upheld, you can send the text again, and if the automated check then holds it back, refuses it or flags it again, a person releases it. You can also go to the courts or complain to the Bundesnetzagentur as Digital Services Coordinator.
- If someone repeatedly publishes manifestly illegal content, we suspend their account for a reasonable period after a prior warning. If someone repeatedly sends manifestly unfounded notices, we stop processing their notices for a reasonable period after a prior warning.
- If content points to a criminal offense against life or safety, we inform the law enforcement authorities (Art. 18 DSA).
§ 12 Changes and updates to the service
- We keep PairMuse in conformity with the contract for its whole term and provide the updates needed for that, including security updates (Section 327f BGB). Because PairMuse runs in the browser, you receive them automatically.
- Beyond that, we change PairMuse only for a valid reason: new legal or regulatory requirements, security, a provider changing or discontinuing an AI model or a service, technical progress, preventing misuse or offering new features. A change costs you nothing extra, and we inform you about it clearly and understandably.
- If a change impairs your access to PairMuse or its use more than insignificantly, we inform you by email in good time beforehand about the features and timing of the change and your right to end the contract. You can then end it free of charge within 30 days; the period starts when you receive our information or, if the change comes later, when the change is made (Section 327r BGB). We refund amounts already paid for the time after the contract ends.
- There is no right to end the contract if the impairment is only insignificant or you can keep using PairMuse unchanged at no additional cost.
- We change how many credits a plan includes and what a credit provides only with your consent (§ 15).
§ 13 Warranty and liability
- The statutory warranty rights for digital products apply to defects (Sections 327 et seq. BGB).
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act (Produkthaftungsgesetz) and where we have given a guarantee or fraudulently concealed a defect.
- For slight negligence we are liable only if we breach an essential contractual obligation, that is, an obligation whose fulfillment makes the performance of the contract possible in the first place and on whose fulfillment you may regularly rely. In that case our liability is limited to the foreseeable damage typical for the contract.
- For products you buy from a shop, the shop is responsible; we are not the seller.
- These rules also apply to people who work for us.
§ 14 Data protection
- How we process your data is set out in the privacy notice at https://pairmuse.com/legal/privacy.
- If you withdraw consent or object to processing, the contract continues. We can terminate it for that reason without notice only if, taking into account the processing that remains permitted and the interests of both sides, we cannot reasonably be expected to continue it. No claims arise against you because you exercise your data protection rights (Section 327q BGB).
§ 15 Changes to prices and to these terms
- We raise the price of a paid plan only with your express consent. We write to you by email at least 30 days beforehand with the new price and the date from which it should apply, and ask you to agree in PairMuse. Silence never counts as consent.
- If you do not agree, your plan continues at the previous price. We can then terminate it under § 6(6).
- Changes to these terms take effect only if you agree to them. We tell you about the changes in good time before the planned date in PairMuse or by email and ask for your consent. If you do not agree, the previous terms continue to apply; we can then terminate the contract under § 6(6).
- Changes to PairMuse itself are governed by § 12.
§ 16 Transfer of the contract
- We may transfer the contract to another company, for example if PairMuse is converted into a corporation. The condition is that we tell you at least four weeks beforehand and name the new contracting party. You can then terminate the contract free of charge and without notice until the transfer; we refund amounts already paid for the time after the contract ends.
- Your account is personal. You can transfer rights and obligations under the contract to others only with our consent.
§ 17 Governing law and disputes
- The law of the Federal Republic of Germany applies. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of the mandatory provisions of the country where you have your habitual residence.
- Send complaints to help@pairmuse.com or through the help form in PairMuse. A person reads and answers them.
- We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 18 Final provisions
- These terms exist in German and in English; both versions are binding. Your contract is governed by the version in the contract language you chose when you concluded it. For the free plan this is the language in which you registered; if you registered in Arabic, English applies.
- If a provision of these terms is invalid, the rest of the contract remains valid. The statutory provisions take the place of the invalid provision (Section 306 BGB).
- You can make declarations to us, such as a cancellation, in text form, for example by email to help@pairmuse.com.
